SUBJECT: University Executive Directive #03-31: Smoking (Supersedes UED #94-17a)
On February 19, 1993, Governor Pete Wilson signed and issued Executive Order
W-42-93, banning smoking in state-owned buildings and leased space. Consistent
with this order, Assembly Bill 291, signed by the Governor on October 11, 1993,
extended this smoking prohibition to include all state-owned passenger vehicles,
as identified in Section 465 of the California Vehicle Code. Both enactments
became effective January 1, 1994.
At the September 2002 Board of Trustees' meeting, the Trustees adopted a
resolution that added Section 42356 to Title 5, California Code of Regulations,
which delegated authority to presidents and the chancellor to adopt rules regulating
smoking on CSU campuses and properties. The resolution was adopted in response
to discussions and concerns about secondhand smoke. Section 42356 gives presidents
and the chancellor authority to set policy regarding regulation of secondhand
smoke on campuses grounds. This University Executive Directive extends the current
prohibition of smoking to 30 feet from a building doorway or ground level air
intake structure.
San Francisco State University Policy Statement on Smoking
I. Policy Statement
It is the policy of San Francisco State University to provide a smoke free
environment for its employees.
II. Background
On February 19, 1993, Governor Pete Wilson signed and issued Executive Order
W-42-93, banning smoking in state-owned buildings and leased space. Consistent
with this order, Assembly Bill 291, signed by the Governor on October 11, 1993,
extended this smoking prohibition to include all state-owned passenger vehicles,
as defined in Section 465 of the California Vehicle Code. Both enactments became
effective January 1, 1994.

Environmental tobacco smoke (ETS) is recognized as the third leading cause
of preventable death, behind active smoking and alcohol, and has been designated
as a carcinogen (known to cause human cancer) by the State of California and
the U.S Environmental Protection Agency. This Legislative ban on smoking will
protect approximately 180,000 state workers from the effects of ETS during the
course of their employment.
III. Provisions
1. University owned buildings and leased space
A. Effective January 1, 1994, smoking shall be prohibited in any campus owned
building or leased space. This prohibition shall apply to any area enclosed
by the outermost walls of the building. Atriums, balconies, stairwells, and
other similar building features are to be considered "within a building."
B. Effective August 1, 2003, smoking shall not be permitted in any outdoor
area within 30 feet of a building doorway or ground level air intake structure.
C. For purposes of fire safety, ashtrays and other appropriate smoking litter
appliances will be provided outside of campus owned and/or leased buildings.
D. The University will not establish and/or identify specific outside areas
for smoking.
2. University owned passenger vehicles and moving equipment
A. Effective January 1, 1994, smoking shall be prohibited at all times in any
University owned vehicle.
B. The smoking prohibition applies to passenger vehicles and all other state
owned mobile equipment to include light and heavy trucks, cargo and passenger
vans, buses, and any other mobile equipment with an enclosed or enclosable driver/passenger
compartment.
IV. Administration
The Dean of each College and or the Director in charge of each facility or
area, (or their designee) shall be responsible for the implementation of the
smoking policy and will establish periodic review of the process to assure conformity.
Deans and Directors will ensure that buildings and leased space covered by this
policy shall at a minimum, have clearly displayed signs at all entrances/exits
and other conspicuous locations (i.e., elevator landings, auditoriums, bathrooms,
etc.) throughout the facilities to notify tenants and the public that smoking
is prohibited within the building.
V. Resolution of Conflict
Where conflict occurs in the implementation of this policy, the Dean or Director
of the work area involved should call the Environmental Health and Occupational
Safety Office. If there can not be resolution at that level, the cabinet level
officer of the facility concerned will determine the course of action.
