Obtaining an Extension of the Deadline for Filing Income Tax Forms

(For Tax Year 2007)

 All individuals in F status, including F dependents, who were in the United States during any part of 2006 must file federal income tax forms, even if they did not have any U.S. earned income!

The deadline for filing income tax forms if you have income is Monday, April 15, 2008. The deadline for filing if you do not have income is June 15, 2008.

What happens if you have income and are unable to file your federal and state income tax forms by the April 15 deadline? You can file for up to a four month extension of your federal income tax form by completing form 4868, Application for Automatic Extension of Time to File a Tax Return. You can obtain a six month extension from the State of California by filing form FTB 3519. Supplies of federal form 4868 and State of California form FTB 3519 may be downloaded from the federal or State of California income tax web pages. Go to OIP's tax links page and click on the appropriate federal or state link. Both forms include instructions.

Forms 4868 and FTB 3519 should be used if you are unable to meet the April 15, 2008 filing deadline for federal and State of California tax returns. Forms 4868 and FTB 3519 provide an automatic four-month extension. However, forms 4868 and FTB 3519 do not allow for an extension of any taxes owed. If you owe tax to the U.S. government or the State of California, you must enclose payment (or an estimated payment) with forms 4868 and FTB 3519. Do not attempt to file the 4868 or the FTB 3519 electronically. File them as paper forms.
