Permanent Status for Less Than Full-Time Employees - Unit I

PURPOSE:
P176. 1 The purpose of this Directive is to implement Article 12, Sections 12.15-12.16 of the CSU/California Federation of the Union of American Physicians and Dentists Agreement which provides that less than full-time employees who have served in Bargaining Unit classifications at a time base of at least 50% time for five (5) consecutive years may be granted permanent status, at the sole discretion of the President.
SCOPE
P176.2 Procedures for granting permanent status for less than full-time employees applies to all eligible employees in Bargaining Unit 1 Physicians.
P176.3 If the provisions of the Directive are in conflict with the Collective Bargaining Agreement reached pursuant to Chapter 12, (commencing with Section 3560) of Division 4 of Title I of the Government Code, the Collective Bargaining Agreements shall take precedence.
PROCEDURES
P176.4 An eligible employee may submit a written request for permanent status to the Director of Student Health Services, with a copy to the Associate Provost for Student Affairs and the Director of Personnel Services.
P176.5 The Director must Complete a performance evaluation and prepare a written recommendation for permanent status. Criteria for review include, but are not limited to, the following: availability of a budgeted position, staffing needs, classifications in which the employee served, performance on the job, material contained in the employee's personnel file, evidence of continuing medical education and if appropriate, CPR certification.
P176.5.1 For eligible current part-time employees with five (5) or more consecutive years of service, the review shall consist of two performance evaluations; an initial review to be completed at the end of the fall academic semester and the second review at the end of the spring academic semester.
P176.6 Upon review and endorsement by the Associate Provost for Student Affairs, the Director's recommendation to grant permanent status, the performance evaluation, and employee's request shall be forwarded to the Director of the Personnel Services Department.
P176. 7 Certification by the Director of Personnel Services as to whether or not the request is in compliance with established criteria and with the Collective Bargaining Agreement, along with the documentation, shall be submitted to the President.
P176.8 The President's determination shall be sent to the employee with copies to the Associate Provost and the Director. All documentation pertaining to the request shall be placed in the employees official personnel file.
