Permanent Status for Temporary Employees, Procedure
Practice Directive P175
Effective Date: September 1, 2000
PURPOSE
P175.1 The purpose of this Directive is to implement Article 9 of the CSU/CSEA Agreement which provides that temporary employees who have served in Bargaining Unit classifications at a time base of at least 50% time or more (as outlined in article 9.11 of the MOU) for three (3) consecutive years may be granted permanent status, at their current time base, at the sole discretion of the President.
SCOPE
P175.2 Procedures for granting permanent status to temporary employees in Bargaining Units:
Unit 2 - Health Care Support
Unit 5 - Operations Support
Unit 7 - Clerical/Administrative Support Services
Unit 9 - Technical Support Services
P175.3 If the provisions of the Directive are in conflict with the Collective Bargaining Agreements reached pursuant to Chapter 12, (commencing with Section 3560) of Division 4 of Title I of the Government Code, the Collective Bargaining Agreements shall take precedence.
PROCEDURES
P175.4 When an eligible employee completes three years of service, the Dean/Director may submit a written request for either permanent or probationary status.
P175.5 Recommendations for probationary status shall be submitted to the Human Resources Director, and the employee will be placed on a performance evaluation schedule. Evaluations and recommendations for permanent status shall be in accordance with article 9 and campus procedures.
P175.6 For permanent status, the supervisor must complete a performance evaluation and submit a written recommendation for permanent status with the evaluation to the Dean/Director for review. Criteria for review include, but are not limited to, the following: availability of a budgeted position, staffing needs, classifications in which the employee served and performance on the job.
P175.7 The Dean/Director's determination, the supervisor's recommendation to grant permanent status, and the performance evaluation, shall be forwarded to the Director of Human Resources for evaluation to ensure compliance with the Collective Bargaining Agreement.
P175.8 Certification by the Director of Human Resources as to whether or not the request is in compliance with established criteria, along with the documentation, shall be submitted to the President.
P175.9 The President's determination shall be sent to the employee with copies to the Dean/Director and the supervisor. All documentation pertaining to the request shall be placed in the employee's official personnel file.
